| NEXT BOARD OF DIRECTORS MEETING The next meeting of the Board of Directors will be held at 7:00 p.m. on Monday, December 10, 2001 at the Marlow residence, 401 Monarch Bay Drive. A homeowner forum will be held at the beginning, to provide the homeowners with an opportunity to discuss issues directly with the Board. The fist meeting of 2002 will be held on Monday, January 14, 2002 at the Stevens residence, 197 Monarch Bay Drive. BEACH CLUB UPDATE On November 21, 2001 the City of Dana Point Planning Commission approved the application by Makar to construct a tram path wich connects the St. Regis Hotel to the Monarch Bay Club. The application was opposed by the MBA and by many residents who wrote letters to the Commission. The City Planning Consultant presented the Commissioners with a resolution that placed restrictions on tram and Club operation designed to mitigate the intensification of use that will result from transport of Hotel guests and others to the Club. The MBA, while still contending that the path should not be constructed and/or used without permission of the MBA, supported the Resolution's conditions. These conditions included a requirement that all events of more than 50 people, any use of tents, or any use of amplified sound shall require a Temporary Permit; and that tram operation shall be limited to between the hours of 8:00 a.m. and 8:00 p.m. It appears that the only concern of the Commission was the impact of the tram operation upon the welfare of the Estates of Monarch Cove (EMC) residents, whose homes are adjacent to the path. This became apparent when a side agreement between EMC and Makar as to the hours of tram operation was presented at the hearing. The Commission adopted the hours agreed to by Makar and EMC. They did not adopt the conditions recommended by Staff which would mitigate the intensified use of the Club by the Hotel. Hours and frequency of tram operation: (A) Start Times: No earlier than one hour after sunrise. (B) Daylight Operations: As and when needed to transport people between the Hotel and the Bay Club and to return. (C) Evening Operations Beginning at sunset, frequency will be limited to four (4) two-way trips per hour (8 total) with the last trams operating as follows: 1. To the Bay Club:Sunday and Weekdays: 7:30 p.m. or sunset, if later Friday and Saturday:9:30 p.m. 2. To the Hotel: Sunday and Weekdays: 10:00 p.m. Friday and Saturday: 11:00 p.m. We are preparing to appeal this matter to the City Council. The progress of the lawsuit is very difficult to report because so much of what is involved is privileged and confidential; but please rest assured that our case is progressing well. The Judge will hear arguments on Makar's motion for a Summary Adjudication on December 19, 2001. Discovery of documents is mostly complete. Depositions of Monarch Bay residents and Makar employees continue. MONARCH BAY GARDEN CLUB The Monarch Bay Home and Garden Club will be having their annual Christmas luncheon at the Surf & Sand Hotel on Wednesday, December 5th. Social hour starts at 11 a.m. followed by lunch at 11:45 a.m. On January 16th the Club will be going to the McCharles Tea House in Old Tustin. Seating is limited so be sure to make your reservation early. Monarch Bay sweatshirts are still available for $18 and can be purchased by calling Margi Rawi at 499-4808. HAPPY HOLIDAYS! We appreciate all of the festive holiday decorations in the community this year, it looks wonderful. We don't want to put a damper on the season, but please remember that all holiday decorations must be removed by the end of the January in compliance with the Association's governing documents. 2002 MONARCH BAY DIRECTORY We are beginning the production of the 2002 Monarch Bay Directory. If you have had any changes since the 2001 directory or are new to the community, please complete the form -available for download in PDF format - and return it to Progressive Community Management by mail or by facsimile by December 17, 2002. We have also added a line for e-mail addresses if you wish to include them. If we do not receive a response from you by December 17, 2002, we will maintain your listing from the 2001 Directory.
