| NEXT BOARD OF DIRECTORS MEETING The next meeting of the Board of Directors will be held at 7:00 p.m. on Monday, October 29, 2001 at the Kranser residence, 75 Monarch Bay Drive. A homeowner forum will be held at the beginning, to provide the homeowners with an opportunity to discuss issues directly with the Board. The next meeting will be held on Monday, December 10, 2001 at the Marlow residence, 401 Monarch Bay Drive. BEACH CLUB UPDATE On October 3, 2001, the Planning Commission had a hearing on the Monarch Bay Club/Makar Properties' application for a permit to expand the exterior deck, as well as, permitting the use of passenger trams on a paved path from the golf course to the parking lot. City Staff recommended to the Planning Commission that the Monarch Bay Club be limited to parties of no more than 75 people, with trams operating from 8 a.m. to 7 p.m., at a rate of 2 round-trips per hour. Furthermore, Staff recommended that there be no tents or amplified music. However, at the hearing, Makar's lawyer stood before the Planning Commissioners and asked for parties of 250 people, with trams operating from 8 a.m. to 11 p.m., at a rate of 8 round-trips per hour. They also requested the use of tents and amplified music. Furthermore, Makar is planning to close the Bay Club's restaurant and bar when there is a hotel party on the lawn. The Planning Commission decided to delay further consideration of the permit until November 21st. They instructed Makar to meet with the City and neighboring communities to develop operational standards for the Bay Club. The Board is working closely with the City. The City is interested in homeowners' opinions and would like to hear from us. Our neighbors in Monarch Cove are impacted by the tram path and they have made a tremendous effort by appearing at Planning Commission hearings, writing letters to the City, and providing photographs of tram and pedestrian activity. Likewise, the Board suggests that you might consider writing letters to the City if you are concerned about the potential noise and impact of the Club disturbing your quiet enjoyment of Monarch Bay. Now would be a good time to express your concerns about large parties, tents, and amplified music. In addition, if the City allows the St. Regis to shut down the Club for large parties, the members will be denied access to the private club. The Association was served by CPH with a Motion for Summary Adjudication, which is scheduled to be heard by the Court on December 19, 2001. A trial date has been set for June 17, 2002. The Association is continuing to pursue all legal remedies in the prosecution of our case against CPH. We are in the discovery phase of our case with depositions and interrogatories. We will continue to update you as more information becomes available. MONARCH BAY GARDEN CLUB The Monarch Bay Garden Club is selling grey sweatshirts with the words "Monarch Bay" and the King Triton emblem in blue. | COMMUNITY WATCH There has been an outbreak of vandalism within the Monarch Bay Association which must be stopped. If you observe destructive conduct, please call the Sheriff's Department at 425-1800. The Community must prosecute, to the fullest extent possible, this unacceptable juvenile activity before it gets out of hand. Parents are urged to be aware of where and what their children are doing. Please remember the Association's rules: Traffic #3 - Prohibits minibikes and motorcycles. Traffic #4 - Un-licensed drivers may not operate motorized vehicles, including golf carts, on Monarch Bay streets. The law provides that parents are financially liable for the misconduct of their children up to $25,000 (Civil Code 1714.1). We want to maintain the reputation of Monarch Bay as a wonderful place to live and appreciate your help in keeping it that way. TRAFFIC STOP SIGNS We urge each resident to strictly adhere to the stop signs within our community, as they have been installed with your safety in mind. The California Driver's Handbook states: " When there are STOP signs at all corners, STOP FIRST; Yield to the car which arrives first or to the car on your right if it reaches the intersection at the same time as your car."
