CITY COUNCIL APPEAL-BEACH CLUB UPDATE
As we previously reported, the Planning Commission on November 21, 2001, approved Makar’s application to construct and operate a tram path which connects the St. Regis Hotel to the Monarch Bay Club. The approval was granted when the residents of the Estates at Monarch Cove, whose homes abut the proposed path, made an agreement with Makar on the hours of tram operation which the Planning Commission endorsed. The Commission did not heed the recommendations of the City Planning Consultant, the arguments presented by the MBA, or the letters many of you wrote to the Commission objecting to the construction of the path which would transport Hotel guests and others to the Club.

The Association has appealed the Planning Commission Resolution, to the City Council. The appeal will be heard at the City Council Meeting of February 12, 2002. The Board would appreciate having a large group of homeowners present to support our position. We suggest you attend the meeting if you are concerned about the tram path and the negative impact its use will have upon our neighborhood and upon our private use of the Club. It will also be helpful to write a letter to the City Council expressing your concerns.

The Council meeting usually starts at 6:30 p.m. There will probably be other issues on the agenda ahead of ours, hence you need not to show up until after 7:30 p.m. Letters should be addressed to the Dana Point City Council, City of Dana Point, 33282 Golden Lantern, Dana Point, CA, 92629. The City Council meetings are usually televised on Channel 30.

COURT RULING-BEACH CLUB UPDATE
Good News....at the January 16, 2002 Court Hearing, CPH’s Motion for Summary Adjudication of Issues was denied. Enclosed please find a copy of the Court’s Minute Order, with corrections and additions for purposes of clarification by Attorney Tom Davis. We will continue to keep you posted.

CONSTRUCTION HOURS
At the January Board meeting, the Board agreed to change the Rules for Construction Activity to conform to the City of Dana Point’s regulations. Effective immediately, construction activity will be prohibited on all Federal Holidays (New Year’s Day, Martin Luther King Day, Presidents Day, Memorial Day, 4th of July, Labor Day, Veteran’s Day, Columbus Day, Thanksgiving Day and Christmas). Additionally, we found a discrepancy in the Membership Directory and the Architectural Guidelines for the start time for Construction Hours on Saturdays. The correct start time on Saturdays is 8:30 a.m. This corrected schedule will be noted in the 2002 Membership Directory which will be mailed to all owners in early February. Please make your contractors aware of both changes. Thank you for your cooperation.

NEXT BOARD OF DIRECTORS MEETING
The next meeting of the Board of Directors will be held at 7:00 p.m. on Monday, February 11, 2002 at the McLeish residence, 101 Monarch Bay Drive. A homeowner forum will be held at the beginning, to provide the homeowners with an opportunity to discuss issues directly with the Board. The March meeting will be held on Monday, March 11, 2002 at the O’Connor residence, 145 Monarch Bay Drive.

ANTI-AIRPORT CAMPAIGN
We have entered the final phase of our battle to stop the airport at El Toro. If we can get the word out county-wide, and remind the voters in all cities of Orange County (except Newport Beach and Costa Mesa) that their vote for Measure F must be followed up with a vote for Measure W, we will preserve our quality of life and property values.

Gary Simon, the Executive Director of LRA (Pro-airport staff), has been quoted as saying that immediately after the County gives them title to El Toro on April 15, 2002, they will begin interim aviation (this means cargo planes). Heavy, dirty, noisy, older aircraft, flying over our community THIS SUMMER!

Goodbye peace and quiet - Hello noise and pollution!!

Please do not rely on your neighbors to carry the financial burden. Buy an insurance policy against the airport. Contribute $1,000 or more if you can. There is no time left - give now!
