LAWSUIT SETTLEMENT UPDATE
Attorneys are working to finalize the documents for our settlement with the Monarch Bay Club. The process takes time since it consists of dozens of pages detailing most aspects of our relationship up to the end of the lease in 2020. These must be carefully drafted and reviewed.

The Club is already adjusting its operations as to large parties so as to conform to the agreement. As you may know, the owners of the Club and our Association agreed on a joint statement about the settlement which went to the media and was published in the Dana Point News on October 3, 2002. We will continue to keep you advised.

NEXT BOARD OF DIRECTORS MEETING
The next meeting of the Board of Directors will be held at 7:00 p.m. on Monday, November 4, 2002 at the Stevens residence, 197 Monarch Bay Drive. A homeowner forum will be held at the beginning, to provide the homeowners with an opportunity to discuss issues directly with the Board. The December meeting will be held on Monday, December 9th at 7:00 p.m. at the O’Connor residence, 145 Monarch Bay Drive.

CONSTRUCTION RULES
Enclosed, please find a copy of the newly revised and adopted rules governing the construction process in Monarch Bay. Please review these rules thoroughly as there have been many changes from the previous restrictions. If you are in the process of constructing or remodeling your home, or plan to do so in the near future, please share a copy of these rules with your contractor. The Board of Directors decided to invoke these rules with strict enforcement beginning November 1, 2002 to protect the rights of all Monarch Bay homeowners. We thank you for your anticipated cooperation.

ANNUAL ASSESSMENT PAYMENT
If you haven’t already done so, please remember to get your payment for your annual assessment to the Monarch Bay Association in before October 31st. For Mall residents, the first quarterly assessment is also due and payable. Please note that late fees are issued the first of November for any payments not received by or on October 31st. We thank you for your cooperation.

IMPROVEMENTS TO YOUR HOME
Exterior improvements to your home, including repainting in a different color scheme, re-roofing or hardscape, needs to be approved in advance by the Architectural Control Committee. Please refer to the Monarch Bay Association Architectural Guidelines for further information, details and the appropriate submittal forms. If you have any questions, please contact Lisa at Progressive Community Management or one of the Architectural Control Committee members listed in your 2002 Membership Directory.
