LAWSUIT SETTLED!
Makar, the owner of the Monarch Bay Club and the St. Regis Hotel, and the Monarch Bay Association (MBA) have agreed in principle to settle the lawsuit filed by the MBA which asked the Court to declare that the Hotel does not have the right to use the Monarch Bay Club. The terms of the agreement, awaiting signatures, include a reduction in the number of Outside and Special Members to offset Hotel use of the Club, restrictions on large parties, limitations on Hotel access and new regulations of Club operations.

There will be only 4 Standing Events sponsored by the Club of up to 250 persons allowed on Memorial Day, Fourth of July, Labor Day and New Years Eve. A Resident Member and only a Resident Member may sponsor a Club party for over 50 persons, and only when approved by the MBA. The Board will determine the rules for larger resident sponsored parties.
Outside Members with vehicular access were reduced from 518 to 250 and Special Members with walk-in access were reduced from 1500 to 56 in return for allowing the St. Regis occupants to use the Club. Hotel occupant use of the Club over the last two years has been in the order of 15 to 20 people a day or less for food and beverage and 30 to 35 maximum for beach use.

Makar has agreed to pay the MBA an annual fee of $50,000 and reimburse the MBA for all of its legal expenses up to $600,000. The MBA has agreed to withdraw objections to the Hotel tram path upon execution of the settlement agreement.

The special legal assessment will be refunded to the homeowners, less any amounts that a homeowner owes to the Association. The refund will come shortly after we receive payment from Makar.

NEXT BOARD OF DIRECTORS MEETING
The next meeting of the Board of Directors will be held at 7:00 p.m. on Monday, November 4, 2002 at the Stevens residence, 197 Monarch Bay Drive. A homeowner forum will be held at the beginning, to provide the homeowners with an opportunity to discuss issues directly with the Board. Due to holiday schedules, the October and November meeting dates have been combined to be held on November 4th.

2002 ANNUAL MEETING OF THE MEMBERS
We successfully held the 2002 Annual Meeting of the Members on September 28th with the election of three incumbent directors to serve a three year term each. Congratulations to: Cliff Anderson, Jess Marlow, and Dr. Richard Selby!

INTERNET FOR ACTIVISTS
Monarch Bay resident Leonard Kranser has published a how-to book based on the use of websites and e-mail in the fight against El Toro Airport. INTERNET FOR ACTIVISTS is "a practical manual for the budding love affair between politics and the Internet.” It is available from Amazon.com, BarnesandNoble.com, and can be ordered at leading bookstores. Kranser will be signing copies at Borders Books on El Paseo off of Cabot Road on Saturday afternoon, October 5 from 2-4 PM.

TEAR DOWN PARTY
On Sunday, October 13th, Dick and Rikki Selby, will be hosting a “Tear Down Party” at their home at 331 Monarch Bay Drive, before the demolition begins on October 15th. The party will be held from 2-6 p.m. and the entire family is welcome. Please wear old clothes and shoes that like paint. BYO: Paint, brushes, crayons, step stools and cans of spray paint. DANA POINT HISTORICAL SOCIETY - HOME TOUR
As many of you know, the Dana Point Historical Society is going to be conducting its Third Annual Historic Home Tour on Sunday, October 6th, from 11 a.m. to 4:00 p.m. This year’s tour will feature homes in Monarch Bay and will include a reception at our park next to the tennis court.
